Own account and third party account
The transport of goods is considered on own account when, among others, the following conditions are met:
- transport does not constitute an economically prevalent activity and represents only a complementary or accessory activity within the framework of the main activity of the aforementioned persons, private or public bodies;
- the transported goods belong to the same persons, private or public bodies or are produced and sold by them, taken on loan, rented or must be processed, transformed, repaired, improved and similar by them or kept in storage in relation to a contract of deposit or to a mandate contract to buy or sell
The legal provisions regarding the transport of goods on one's own account do not apply to motor vehicles with a total weight when fully loaded, not exceeding 6 tonnes.
The license to transport goods on one's own account is issued within 45 days of receipt of the application, complete with the required documentation.
THIRD PARTIES
Access to the profession of haulier is permitted to the following individuals:
- individual businesses
- society
- consortia and cooperatives with divided ownership (for these entities registration in a special section of the Register regulated by Presidential Decree 155/1990 is required)
For companies that carry out this activity of road transport of goods on behalf of third parties with vehicles with a total weight of up to 1.5 tonnes when fully loaded, it will be sufficient to demonstrate the requirement of good repute to be registered in the Register.
Beyond the limit of 1.5 tonnes, the requirements for registration in the Register of Hauliers without limitations are:
- honorability;
- financial capacity;
- professional suitability
The requirement of professional suitability exists if the person proves that they have gained particular practical experience, provided they pass the "control exam" which consists of a simplified suitability test.
To carry out the activity of haulier of goods on behalf of third parties, it is necessary to possess a specific certificate of professional suitability necessary for registration in the National Register of Road Hauliers of goods on behalf of third parties.
